Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P. and perused the record. 2. The present bail application has been filed on behalf of the applicant in Case Crime No.117 of 2025 under Sections 105, 110 BNS, Police Station Isanagar, District Lakhimpur Kheri, with the prayer to enlarge him on bail. 3. Learned counsel for the applicant submitted that the applicant is an innocent person and has been falsely implicated in the present case and he is in jail since 21.04.2025. As per the prosecution case, husband of complainant, namely, Ram Dayal (now deceased) was passing through the way and one person on the motorcycle bearing No.UP 31 CE 1614 came from opposite direction and hit him hard, due to which, Ram Dayal fell on the fencing which was made by the applicant around his agricultural field. During the incident, Ram Dayal received severe injury, as a result, he died. It is further alleged that in case, the fencing was not made, no such incident could take place. He further submitted that the alleged fencing was made for the protection of crop and there was no intention of the applicant to harm anyone. He further submitted that applicant is having no criminal antecedent and charge sheet has already been filed and there is no possibility of tampering of any evidences. In these circumstances, the applicant is entitled for bail. In case of being enlarged on bail, he will not misuse the liberty of bail. 4. Learned A.G.A. opposed the prayer of the applicant for grant of bail and submitted that sufficient evident has been found against the applicant, thereafter, the charge-sheet has been filed. Therefore, he is not entitled to be released on bail. 5. Considering the rival submissions of learned counsel for parties, material available on record, contents of the F.I.R., other relevant documents as well as totality of fact and circumstances, it is evident that the alleged fencing was made by the applicant for the protection of crop and there was no intention of applicant to harm anyone. Therefore, I am of the view that the applicant is entitled to be released on bail. 6.
