Neutral Citation No. - 2025:AHC-LKO:35675-DB Court No. - 1 Case :- WRIT - C No. - 5856 of 2025 Petitioner :- Saurabh Pandey Respondent :- Additional District Magistrate, Ivth Lucknow And 2 Others Counsel for Petitioner :- Surendra Yadav,Priyanka Gupta Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Vakalatnamas filed by Sri Chandra Shekhar Sinha and Sri Puneet Kumar Verma learned counsel on behalf of the opposite party nos. 2 and 3 respectively are taken on record.
2. Heard learned counsel for the petitioner, learned Standing Counsel for the State, Sri Chandrashekar Sinha
learned counsel for the opposite party no. 2 and Sri Puneet Kumar Verma learned counsel who has put in appearance on behalf of the opposite party no. 3.
3. We do not find it a fit case for being entertained under Article 226 of the Constitution of India as the proceedings under Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 initially instituted have failed due to a default on the part of the petitioner himself. Even a subsequent S.A. No. 183 of 2025 instituted before the Debts Recovery Tribunal is sub-judice.
4. In these circumstances, it is open to the petitioner to avail of the remedy before the Debts Recovery Tribunal
itself/appellate tribunal as he may be well advised.
5. The writ petition is not maintainable and the same is accordingly dismissed. . [Subhash Vidyarthi,J.] [Attau Rahman Masoodi, J.]
