HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8041 of 2023
Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard Shri Harendra Singh, Advocate and Shri Manoj Kumar Sahu, learned Amicus Curiae for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.17 of 2023, under Section 498A, 304B IPC & Section 3/4 of D.P. Act, P.S. Ajgain, District Unnao. 3. In terms of the FIR, it was alleged that the daughter of the informant was married to the applicant 12.05.2022. Subsequently, on 22.01.2023, she was killed by the entire matrimonial family. It is argued that the post- mortem report indicates the cause of death as ante mortem hanging and ligature mark was observed. No other external injury was seen all over the body. 4. Learned AGA has opposed the bail application. 5. Considering the post-mortem report and the fact that there is no allegation that soon before the death, the victim was subjected to any mental or physical harassment in relation to demand of dowry coupled with the fact that the applicant has no criminal history and is in custody since 29.01.2023, the applicant is entitled to be enlarged on bail.
