Neutral Citation No. - 2025:AHC-LKO:35691 Court No. - 2 Case :- WRIT - B No. - 564 of 2025 Petitioner :- Nirmal Bahadur Singh And Another Respondent :- Board Of Revenue U.P. Lucknow Thru. Chairman And 3 Oths. Counsel for Petitioner :- Rama Kant Dixit,Anuj Kumar Mishra Counsel for Respondent :- C.S.C. Hon'ble Subhash Vidyarthi,J.
1. Heard Shri Ram Vishal Tripathi, Advocate holding brief of Shri Rama Kant Dixit, learned counsel for the petitioner and Shri Raj Baksh Singh, the learned Additional Chief Standing Counsel appearing for the respondent.
2. By means of the instant petition filed under Article 226 of the Constitution of India, the petitioner has challenged the validity of an order dated 22.04.2025 passed by the Board of Revenue in Revision No.1706/2005-2006 whereby the Board of Revenue has dismissed the Revision filed against an order dated 13.06.2006 passed by the Naib Tehsildar, whereby an application filed by the petitioner seeking recall of an order dated 24.11.2003 was rejected. By means of the order dated 24.11.2003, an order dated 20.12.2002 had been set-aside, which order was passed after closing an opportunity to lead evidence.
3. The revisional Court has held that the parties will have an opportunity to place their case before the Naib Tehsildar and, therefore, there is no good ground to entertain the Revision.
4. In view of the aforesaid facts, there appears to be no illegality in the order dated 22.04.2025 as warrants interference by this Court in exercise of its extraordinary writ jurisdiction.
5. The learned counsel for the petitioner submits that the matter is pending since long and there is an apprehension of further
undue delay in disposal of the matter.
6. In order to obliviate this apprehension, it is observed that the authority concerned shall proceed to decide the matter expeditiously, without granting any unnecessary adjournment to any of the parties. The writ petition is disposed off with the aforesaid direction. .
