THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.9375 of 2025 ORDER: This writ petition is filed seeking for a direction to Respondent Nos.2 to 4 not to initiate any action of seizing the Flour Mill without conducting any survey.
2. The Petitioner is doing small business of flour shop in the outskirts of Nellore Municipal Corporation i.e. at D.No.27-03- 2220, N.T.R Nagar, Nellore in the name and style of ‘Sri Gayathri Flour Mill’. While so, on 28.03.2025, a notice was issued to the Petitioner under Sections 41, 44, 51 and 134 of the Andhra Pradesh Public Health Act, 1939 stating that complaints were received regarding the pollution caused by the flour mill and in that context the Petitioner was directed immediately to stop grinding of dried chillies in the flour mill. The apprehension of the Petitioner is that without putting the Petitioner on notice, the Respondent-Authorities are threatening to shut-down the flour mill. Hence, the present writ petition is filed.
3. Learned standing counsel on instructions submits that as on date, there is no hindrance for the Petitioner to operate the flour mill and in the event of any action being taken against the

Petitioner, procedure of law would be followed as prescribed under the Act.
4. Taking into the consideration the instructions submitted by the learned standing counsel, the writ petition is disposed of directing the Respondents to follow the due process of law prescribed under the Statute before taking any action against the Pettiioner.
