JUSTICE DEEPAK ROSHAN ---- For the Petitioner : Mr. Prashant Pallav & Parth Jalan, Advs For the Opposite Party : Mr. Azeemuddin, Public Prosecutor --- 02/03.06.2025 The instant application has been filed for grant of regular bail in connection with Amrapara P.S Case No. 15 of 2025 registered under Section 191(2), 191(3), 190, 126(2), 127(2), 137(2), 308(2), 308(3), 308(5), 305(a), 74, 76, 109, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Chief Judicial Magistrate, Pakur. 2. Learned counsel for the Petitioner submits that there was a fight between two groups and the Petitioner being a youtuber posted the video of the incident online and there is only allegation against the Petitioner that he himself participated in fight and posted the video online. He further submits that the Petitioner has no criminal antecedent and he has been in custody since 13.03.2025. 3. Leaned A.P.P has opposed the prayer for bail of the petitioner and submits that there is serious allegation against the petitioner made in the FIR; hence he prays that the Petitioner does not deserve bail. 4. Having regard to the aforesaid facts and circumstances of the case and looking to nature of allegation made against the Petitioner, coupled with the period of custody of the petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the above-named petitioner is directed to be 2025:JHHC:14472 2 enlarged on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Pakur, in connection with Amrapara P.S Case No. 15 of 2025. It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
