Neutral Citation No. - 2025:AHC-LKO:35777 Court No. - 2 Case :- WRIT - A No. - 6807 of 2025 Petitioner :- Khushi Ram Verma Respondent :- State Of U.P. Thru. Secy. Secondary Education Deptt. Lko. And 5 Others Counsel for Petitioner :- Prabhat Kumar Mishra,Arun Kumar,Deepmani Shukla Counsel for Respondent :- C.S.C. Hon'ble Subhash Vidyarthi,J. 1. Heard Sri Prabhat Kumar Mishra, learned counsel for the petitioner and Ms. Deepshikha, learned Chief Standing Counsel for the State. 2. By means of the instant writ petition, the petitioner has challenged the validity of an order dated 19.03.2025 passed by the District Inspector of Schools, Sitapur, rejecting the petitioner's application for grant of extension of service for a period of two years. The petitioner retired after attaining the age of superannuation on 31.03.2024 while he was working as Special Guest Subject Expert in Trade Radio and Color Television in Sri Hanumant Rameshwar Dayal Inter College, Biswan, District Sitapur. The petitioner was given the benefit of continuance in service till the end of the session, but his services were not extended. 3. Learned counsel for the petitioner has submitted that a Government Order dated 28.06.2019 (a copy whereof has been filed as Annexure No. 5 to the writ petition) provides that guest subject experts may be granted extension of service for a period of two years at a time, till they attain the age of 70 years, upon recommendation made by a committee constituted by the Chief Development Officer, which includes the District Inspector of Schools, Principal of the Government Inter College and a subject expert nominated by the Chief Development Officer, after taking into consideration their work and qualifications. 4. While rejecting the petitioner's claim for extension of service, the District Inspector of Schools, Sitapur has recorded in the impugned order dated 19.03.2025 that the Principal of Sri Hanumant Rameshwar Dayal Inter College, Biswan, District Sitapur has submitted a report stating that there are no students of Trade Radio and Color Television in Class XI in the session 2024–25. There are total 12 students in Class XII, whose board examinations have concluded. As there are no students in Classes XI and XII in Trade Radio and Color Television, there is no requirement of any Guest Subject Expert. 5. The District Inspector of Schools, Sitapur has come to the conclusion that granting extension of service to the petitioner, even when there are no students as per the report of the Principal, would result in wastage of public money and, therefore, it would not be proper to grant extension of service to the petitioner. 6. Having considered the aforesaid facts and circumstances of the case, I find that the District Inspector of Schools, Sitapur has rejected the petitioner's claim on the basis of a cogent reason. There appears to be no illegality in the impugned order dated 19.03.2025. The writ petition lacks merit and the same is, accordingly, dismissed.
