There is no representation for the third respondent. 2.The petitioner is the son of late Azhagarsamy, who had earlier filed a suit in O.S.No.73 of 1995 for declaration and for a permanent injunction against eleven persons, which included one N.Perumal as 11th defendant. Suit came to be decreed on 28.02.1997. However, the 11th defendant therein appears to have approached the respondents by filing an application for issuance of building planning permission for putting up construction, dated 03.10.2013. The said application was also processed and permission was granted on 03.10.2013. Thereafter, the petitioner along with his mother and siblings have filed a suit before the Sub Court III, Madurai in O.S.No.343 of 2014, which is said to be pending. It is the case of the petitioner that though the petitioner’s parent has secured the judgment and decree from the District Munsif Court at Madurai in O.S.No.73 of 1995 on 28.02.1997, the third respondent has given the building planning permission to the said N.Perumal. 5. It is not clear under what circumstances building permission was granted to the said N. Perumal. Further, N. Perumal has not been made a party to the present proceedings. It is quite possible that the decree obtained by the petitioner’s parent in O.S. No.73 of 1995, from the District Munsif Court at Madurai on 28.02.1997, was suppressed. Unless there are clear indications that the permission granted to the said N. Perumal on 03.10.2013 was issued with knowledge of, and in defiance of, the aforesaid judgment and decree passed in O.S. No.73 of 1995 dated 28.02.1997, the request of the petitioner for initiating proceedings against the third respondent under Rule 20 of Tamil Nadu Government Servant Conduct Rules, 1973 cannot be countenanced. 5/9 https://www.mhc.tn.gov.in/judis W.P.(MD).No.16264 of 2024 6. In these circumstances, this writ Petition is liable to be dismissed. However, liberty is given to the respondent Nos.1 and 2 to call for the records and to re-examine the issue afresh and to examine whether indeed the third respondent has given the planning permission to the said Perumal even though with the knowledge of the judgment and decree in O.S.No.73 of 1995, dated 02.02.1997. 7. Before passing any order, an enquiry shall be conducted by summoning the petitioner and the said Perumal, who was the 11th defendant in the above said suit, within a period of eight weeks from the date of receipt of copy of this order. 8. With the above direction and liberty, this Writ Petition is dismissed.
