This anticipatory bail application under Section 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 323, 341, 498A, 504, 506 of the Indian Penal Code and Section 3/4 of D.P. Act pending in the court of learned J.M. 1st Class, Giridih in connection with Complaint Case No. 510 of 2022. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. Since the case arises out of compliant there is no question of custodial interrogation. Further cognizance has already been taken and summons have been issued. 5. In view of the judgment passed by the Hon’ble Supreme Court in the case of “Arnesh Kumar vs. State of Bihar” reported in (2014) 8 SCC 273 and “Satender Kumar Antil vs. CBI and Anr.” reported in (2022) 10 SCC 51, I direct the petitioner to appear before the trial Court since there is no question of arrest in this case and take appropriate steps. 6.
