The instant application has been filed seeking following main relief(s) :- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the impugned Summoning order dated 18.08.2009 in S.T. No.322/2020 (Complaint Case No.4378/2009) (State V/s Kaldar Singh and others), Under Section 307 IPC against the Petitioners, pending in the court of II Additional District and Sessions Judge, Raibareli including entire proceedings initiated in pursuance thereof, contained in Annexure No.1 to the Petition. It is further prayed that this Hon'ble court may kindly be pleased to quash the entire criminal proceeding of S.T. No.322/2020 (Complaint Case No.4378/2009) (State V/s Kaldar Singh and others), Under Section 307 IPC relating to Police Station -Sareni, District-Raibareli, pending in the II Additional District and Sessions Judge, Raibareli, on the basis of compromise, in the interest of justice." On account of some formal defects crept in the application, learned counsel for the applicants prays for withdrawal of the present application with liberty to the applicants to file afresh with proper pleadings and documents in support thereof. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty as prayed for. Office is directed to return certified/original copies of the documents annexed with the application to the learned counsel for the application as per rules.
