JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner : Mr. Lalit Yadav, Advocate For the State : Mr. Praful Jojo, A.P.P. ----- 07/25.08.2025 The petitioner is apprehending his arrest in connection with Complaint Case No.8/2023, registered under Section 33(i)(c) of the Indian Forest Act, pending in the Court of learned Additional Chief Judicial Magistrate, Chatra. 2. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 13 of this application. He submits that the allegations are made that in the forest area, poppy plant has been cultivated. He further submits that the petitioner has nothing to do with the said cultivation and the name of the petitioner has come on the basis of the information provided by the villager. He submits that the name of the person, who has given information about the petitioner, has not been disclosed in the complaint case. 3. Learned counsel for the State opposed the prayer and submits that the allegations are there of cultivating poppy plant. 4. Considering that the petitioner has got no criminal antecedent and even the land has been denied and further, the person who has disclosed the name of the petitioner, his name has not been mentioned in the complaint case and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 5. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Complaint Case No.8/2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
