BEFORE HONOURABLE MR. JUSTICE NELSON SAILO ORDER Date : 25.07.2025
Heard Mr. S. U. Ahmed, learned counsel for the petitioner. Also heard Ms. S. Chutia, learned Standing Counsel, Elementary Education Department for the respondent Nos. 1 and 4 and Mr. B. Deuri, learned Govt. Advocate for the respondent Nos. 2 and 3. 2. Having regard to the nature of the grievance projected by the petitioner, the writ petition is taken up for disposal at this stage. 3. It is the case of the petitioner that her father who was working as Assistant Teacher at Kasomari Bilpar L. P. School, died-in-harness on
18.03.2017. The petitioner therefore applied for compassionate appointment before the authority concerned on 12.02.2018. Her case was not considered for a long time, therefore she submitted a representation on 01.08.2024 before the respondent No.3 and thereafter, the District Level Committee (DLC) Darrang on 07.08.2024 considered the case of the petitioner and recommended her name to be considered by the State Level Committee (SLC) for appointment as Assistant Teacher. However, in the meantime, the State Government in the Personnel (B) Department came up with Office Memorandum dated 18.09.2024, by which compassionate Family Pension Scheme has been introduced instead of the Compassionate Appointment Scheme. Aggrieved, the petitioner is before

It is also the case of the petitioner that similar other writ petitions have been filed before this Court and this Court by a common order dated 03.04.2025, the lead case being WP(C)/342/2025 disposed of the writ petitions by directing the respondent authorities to consider all the pending cases for compassionate appointment as per the relevant guidelines formulated by the State Government. It is therefore the case of the petitioner that since her case has been recommended by the DLC, Darrang, her case may be place before the SLC for consideration. 5. Having perused the materials available on record, it is seen that the case of the petitioner is also covered by the earlier decision of this Court and accordingly, the respondents are directed to place the case of the petitioner before the next SLC meeting for consideration of her appointment on compassionate basis. The respondent No.3 shall do the needful for placing the case of the petitioner before the SLC. 6. With the above observations and directions, the writ petition accordingly stands disposed of.
