The instant application has been preferred by the petitioner for modification of the order dated 05.07.2019, passed in Cr. Revision No.1246 of 2014, whereby the petitioner was directed to be released under Section 4 of Probation of Offenders Act after entering into a bail bond of Rs.5,000/- with two sureties with a like amount each for keeping peace and good behavior for a period of two years, failing which he shall serve rest of the sentence as ordered by the learned Trial Court. 3. Learned counsel for the petitioner submits that due to some miscommunication with his Lawyer, the petitioner could not file probation bond/ bail bond for keeping peace and good behavior for the aforesaid period, in time. Learned counsel further submits that in the interest of justice the time for depositing the bail bound for keeping peace before learned Trial Court be extended by modifying the order dated 05.07.2019, passed in Cr. Revision No.1246 of 2014 to the extent that the bail bound for keeping peace of Rs.5,000/- may be directed to be deposited within a further period of one month from today. 4. Learned APP does not have any objection. 2025:JHHC:18858 2 5. Having heard learned counsel for the parties and after perusing the order dated 05.07.2019, passed in Cr. Revision No.1246 of 2014, I hereby modify para-7 of the order dated 05.07.2019 to the extent that the petitioner is directed to submit probation bond of Rs.5,000/- with a like amount each for keeping peace and good behavior for a period of two years, within a further period of six weeks from today before the before the learned Trial Court. 6. With the aforesaid modification, the instant Cr.M.P is hereby allowed. 7. Let a copy of this order be communicated to the concerned court through “FAX”. (Deepak Roshan, J.) kunal/-
