Sir, With reference to the subject cited above, I would like to inform you that Smti. Renuka Thakuna.
Salesman, Assam Khadi & Village Industries Board was retired from the active service of the Board on 31.03 2016 on superannuation. Her retirement benefits were not released at that time because an amount of Rs.44,10,574.58 was detected by the internal audit as misappropriated amount against Smti. Renuka Thakuria which were occurred during the period 1996 to 31.03.2016. The proposal for the entire retirement benefits was submitted to the Govt. at that lime and the said amount was received by the AKVI Board. But the same could not be released to Smti Renuka Thakuria for the reason as stated above and the amount was duly utilised for payment of retirement benefits to other retired employees for which Utilisation Certificate was duly submitted to the Govt. during that period. Now, the Hon'ble Gauhati High Court has passed an order to submit Supplementary Demand proposal to the Govt for sanction & release of the entire retirement benefits of Smti Renuka Thakuria vide order as stated above. The total retirement benefit of Smti. Renuka Thakuria arrives at Rs. 18,19,169.00. The details are enclosed herewith at Annexure-1. 1, therefore, request you kindly to take necessary steps to sanction & release the amount of Rs. 18,19,169. 00 for payment of relirement benefit of Smti. Renuka Thakuria as per Hon'ble Gauhall High Court order. Erclo As stated above

13. A perusal of the said letter indicates that the total retirement benefits of the petitioner after calculation arrived at Rs. 18,19,169.00/- and accordingly, the respondent Khadi & Village Industries Board requested the respondent Handloom Textiles & Sericulture Department to sanction and release the said amount for payment of retirement benefits to the petitioner. It is also worthwhile to mention that the admitted retirement benefit which is admittedly calculated and fixed at Rs. 18,19,169.00/- has not been released to the petitioner since her date of retirement, i.e. 31.03.2016.
The respondent Khadi & Village Industries Board being the authority to release the aforesaid retirement dues is taking the stand before this Court that unless and until the said amount is released from the respondent Handloom Textiles & Sericulture Department, they are not in a position to make the payment and that they have already requested the respondent Handloom Textiles & Sericulture Department for releasing the said amount. 14. On the other hand, the stand of Mr. R. Dhar, learned Standing Counsel, Handloom Textiles & Sericulture Department is that funds are not released against specific employee of the respondent Khadi & Village Industries Board and that the funds as sought for has already been released in Grands-in-Aid to the respondent Khadi & Village Industries Board. 15. Be that as it may, it appears that the petitioner is running pillar to post for
Page No.# 11/11 her retirement benefits since 2016, despite the retirement benefits being admitted. It shocks the conscience of this Court as how the respondents are casually dealing the case of the petitioner whose retirement benefits for the last so many years have not been released, despite the same being admitted. It is a clear case of injustice being done to the petitioner. This Court is not concerned as how the respondent Khadi & Village Industries Board is going to manage the fund, in order to release the entitled retirement benefits of the petitioner. It is the obligation of the respondent Board to release the retirement benefits of their employees. Accordingly, this Court deems appropriate to dispose of the writ petition, in the interest of justice, by directing the respondent Khadi & Village Industries Board to release the admitted retirement benefits of the petitioner within a period of 4 (four) months from the date of receipt of a certified copy of this order. Ordered accordingly. 16.
It is needless to be clarified that the respondent Handloom Textiles & Sericulture Department shall co-operate and do the needful in accordance with law, so as to enable the respondent Khadi & Village Industries Board to comply with the instant order of this Court. 17. Accordingly, the writ petition stands disposed of. JUDGE Comparing Assistant
