HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CRM (M) No. 708/2025 Vijay Gupta …..Appellant(s)/Petitioner(s) Through: Mr. Arvind Bandral, Advocate Vs U.T. of J&K and another .…. Respondent(s) Through: Mr. Suneel Malhotra, GA Coram: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 31.08.2026 1. The petitioner, through the medium of the instant petition, has pleaded that the FIR impugned in the present petition, i.e. FIR bearing No. 0316/2024, is a counterblast to the previous FIR lodged by the petitioner on 02.10.2024, bearing FIR No. 0316/2024 and no other ground has been pressed by the learned counsel appearing on behalf of the petitioner. 2. Learned counsel for the petitioner further submits that he would feel satisfied in case the impugned FIR is also investigated by the same Investigating Officer, as the same would suffice the purpose. Therefore, he submits that the instant petition can be disposed of if such direction is issued and Mr. Suneel Malhotra, learned GA who has appeared on behalf of the respondents is not averse to the said proposition. 3. Since an innocuous prayer has been made, therefore, with the consent of learned counsel for the parties, the instant petition is taken for disposal and the same is disposed of by directing that the impugned FIR bearing Sr. No. 40 CRM (M) No. 708/2025 No. 0084/2025 dated 19.02.2025 shall also be investigated expeditiously by the same Investigating Officer who is investigating the FIR lodged by the petitioner bearing No. 0316/2024. 4. The writ petition, in the aforesaid backdrop, is disposed of along with all connected application(s). (Wasim Sadiq Nargal) Judge Jammu 31.08.2026 Nikhil
