1. Learned counsel for the applicant is directed to correct the description of respondent no.2, forthwith. 2. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 3. The present bail application has been filed on behalf of the applicant seeking anticipatory bail in F.I.R. No. 129 of 2025, under Sections 3(5), 61(2), 316(4), 338, 336(1), 336(2), 340(2), 351(3) BNS, Police Station Masauli, District Barabanki. 4. Learned counsel for the applicant submits that the applicant has falsely been implicated in the present case. It is further submitted that applicant was working as an accountant in the firm of the private respondent, thereafter, on the advise of the private respondent, applicant consented for a new firm and new firm was created by the private respondent adding name of the applicant. The said firm was also ran by the private respondent and when the liability of G.S.T. was found on the said firm, then applicant made a complaint to the authorities, as a result, private respondent felt annoyed, thereafter, his father lodged an F.I.R. No.147 of 2025 under Sections 319(2), 318(4), 338, 336(3), 340(2), 316(2), 3(5), 344, 316(4), 351(3) BNS, Police Station Kotwali Nagar, Barabanki. Thereafter, anticipatory bail was filed before this Court, which was allowed vide order dated 8.5.2025 passed in Anticipatory Bail Application U/S 482 BNSS No.409 of 2025, then private respondent also filed an F.IR. of case in question with the same verbatim. He further submits that applicant is ready to cooperate in the investigation, therefore, no custodial interrogation is necessary. In such circumstances, applicant is entitled for protection of this Court under the provisions of anticipatory bail. 5. Learned A.G.A. opposes the prayer of the applicant but he does not dispute this fact that contents of the earlier F.I.R. and present F.I.R. is identical in nature and in the earlier case, applicant has already been enlarged on anticipatory bail. 6.
I have considered the argument of the learned counsel for the applicant, learned A.G.A. as well as learned counsel for the complainant and gone through the contents of the F.I.R., bail application and other relevant records. 7.
