Mr. Aman Shekhar, Advocate For the State : Mr. Naveen Kr. Gaunjhu, AddI. P.P.
…...... 04/ 19.06.2025: Heard, learned counsel for the parties.
2. This is an application filed by the petitioner praying for grant of anticipatory bail under Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Section 85/82 of Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961 in connection with Sahibganj (T) P.S. Case No.145 of 2024, pending in the Court of learned Chief Judicial Magistrate, Sahibganj.
3. It is alleged that by giving false information of facts, the petitioner married the informant. It is alleged that petitioner posed himself to be a Doctor, thereafter got married with the informant and had also taken Rs.10 lakhs from the family of the informant and now he has driven out his wife. He has a son from the informant.
4. From the impugned order, I find that notice under Section 35(3) of BNSS has been issued to the petitioner, but the petitioner has not appeared. Admittedly, no warrant has been issued till date. Thus, the petitioner should appear before the Investigating Officer.
5. Since, under Section 35(3) of BNSS has been issued it is presumed that the police did not find it necessary to arrest the petitioner.
6. Petitioner is directed to appear before the Investigating Officer and take appropriate step, including appearing before the Court concerned.
7. Accordingly, the instant anticipatory bail application stands disposed of.
