The instant petition has been preferred seeking following main relief(s):- "i. Issue a writ, order or direction in the nature of mandamus commanding the opp. Parties concerned to take the necessary action regarding the grievances of the petitioners raised in the application as contained in Annexure No 1 to this writ petition and protect the land of petitioner mentioned in the application from grabbing by the opp. parties concerned and take the necessary action against the opp. parties concerned in accordance with law in the interest of the justice. ii. Issue a writ order or direction in the nature of mandamus commanding the opp. Parties concerned to consider and decide the application of petitioners as contained in Annexure no. 1 to this writ petition in the interest of justice." Learned Additional C.S.C. appearing on behalf of the State, on the basis of instructions dated 11.6.2025 received from the respondent No. 6, made a statement that no interference has been caused by the respondents-authorities. The instructions provided by the learned Additional C.S.C. are taken on record. The relevant portion thereof is quoted hereinbelow for convenience:- "1. यह ककि उपररोक्त ररट ययाकचिकिया ययाकचिकियाकिरयार्ता दयारया इस आशय ससे यरोजजिर किकी गययी हहै ककि कविपकयीगणणों किरो ययाचियी किसे प्रत्ययाविसेदन किरो कनस्रयाररर ककियसे जियानसे हसेरतु रथया ययाकचिकियाकिरयार्ता किकी भभूकमि किरो ससंबसंजधिर कविपकयी पकणों दयारया हड़पनसे ससे बचियानसे और न्ययाय किसे कहर मिम कियानभून किसे अनतुसयार ससंबसंजधिर कविपकयी पकणों किसे जखिलयाफ आविश्यकि कियारर्तावियाई किरनसे किसे जलए आदसेकशर / कनदरकशर किरनसे किकी ययाचिनया किसे सयाथ प्रस्रतुर किकी गययी हहै। 2. यह ककि प्रस्रतुर प्रकिरण मिम मियाननयीय उच्चि न्ययाययालय किरो सयादर अविगर किरयानया हहै ककि प्रथमि पक किसे 1. पविन कितु मियार पतुत्र स्वि० गसंगयाचिरन उम्र किरयीब 30 विरर्ता 2. गतुडभू उफर्ता किक ष्ण कितु मियार पतुत्र स्वि० गसंगयाचिरन उम्र किरयीब 40 विरर्ता 3. कशविपतुजिन पतुत्र स्वि० गसंगयाचिरन उम्र किरयीब 35 विरर्ता 4. कशविपभूरन पतुत्र स्वि० गसंगयाचिरन उम्र किरयीब 24 विरर्ता कनवियासयी गयामि बयीकियापतुर थयानया दररययाबयाद बयारयाबसंकिकी वि कदरयीय पक किसे 1. रयामिरुप पतुत्र प्ययारसेलयाल उम्र किरयीब 52 विरर्ता 2. कदलयीप कितु मियार पतुत्र रयामिरुप उम्र किरयीब 32 विरर्ता 3. कदपभू पतुत्र रयामिरुप उम्र किरयीब 30 विरर्ता 4. प्रदयीप पतुत्र रयामिरुप उम्र किरयीब 26 विरर्ता कनवियासयी गयामि बयीकियापतुर थयानया दररययाबयाद जिनपद बयारयाबसंकिकी किसे मिध्य खिसेर किसे सयीमियासंकिन किरो लसेकिर रनयावि वि किसयीदगयी व्ययाप्त हहै उभय पक किभयी भयी लड़झगड़किर ससंजसेय अपरयाधि कियाररर किर सकिरसे हह। 3. यह ककि शयासंकर व्यविस्थया वि कियानभून व्यविस्थया बनयायसे रखिनसे किसे जलयसे उभय पकरो किया चियालयान अन्रगर्तार धियारया 126 / 135 बयी.एन.एस.एस. मिम मियाननयीय न्ययाययालय ककियया गयया हहै। जजिसकिया रस्किरया जियी०डयी० ससं 0-30 कदनयासंकि 10.06.2025 समिय 17.58 बजिसे असंककिर ककियया गयया। 4. यह भयी सयादर अविगर किरयानया हहै ककि रयाजिस्वि कविभयाग किकी टयीमि किसे दयारया प्रकिरण किसे सम्बन्धि मिसे मिमौकिसे पर जिया किर पहैमियाईश ककियया गयया, रत्समिय मिमौकिसे पर शयानन्र व्यविस्थया वि सतुरकयाथर्ता पययार्ताप्त पतुजलस बल मिमौजिभूद रहया। 5. यह ककि इस सम्बन्धि मिसे थयानया हयाजिया पर ककिसयी प्रकियार किकी कशकियायर अथविया वियाद दजिर्ता नहयी हहै और न हयी थयानया हयाजिया पतुजलस किसे दयारया ककिसयी प्रकियार किकी कियायर्तावियाहयी किकी गययी हहै। उक्त प्रकिरण जिरो ककि भभूकमि कविवियाद ससे सम्बनन्धिर हहै। जिरो पभूणर्तारूप रयाजिस्वि कविभयाग किया प्रकिरण हहै। रयाजिस्वि कविभयाग किकी कियायर्तावियाहयी मिम पतुजलस दयारया पभूणर्ता सहयरोग ककियया जियायसेगया रथया स्थयानयीय पतुजलस दयारया कविजधि किसे कविरूद्ध किरोई कियायर्तावियाहयी नहहीं किकी गई और रयाजिस्वि कविभयाग ससे सम्बनन्धिर प्रकिरण मिसे पतुजलस किसे दयारया हस्रयाकसेप नहयी ककियया जिया रहया हहै और न हयी भकविष्य मिसे शयानन्र व्यविस्थया किसे अकरररक्त ककिसयी प्रकियार ससे हस्रयाकसेप ककियया जियायसेगया। 6. यह ककि ययाकचिकिया मिम अकगमि कियायर्तावियाहयी मिया० उच्चि न्ययाययालय, लखिनऊ खिण्ड पयीठ, लखिनऊ मिहरोदय किसे पयाररर आदसेशयानतुसयार एसंवि कनदरशरो किसे अनसयार आदसेश किया पयालन ककियया जियायसेगया।" Taking into consideration the statement made by the learned Additional C.S.C. as well as the instructions as quoted hereinabove, this Court finds that no useful purpose would be served to keep this writ petition pending. Accordingly, the writ petition is disposed of. Needless to say, it is open for the petitioner to approach the court concerned by preferring an application under Order 39 Rule 2A of CPC, as per law.
