Chaturvedy, learned counsel for the petitioner and Mr. Bishambhar Shastri, learned A.P.P. appearing for the State. 2. Petitioner has been made accused in connection with Murhu P.S. Case No. 30 of 2012 corresponding to G.R. Case No.169 of 2012 for the offences registered under Sections 302, 201 and 34 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act. 3. Learned counsel for the petitioner has submitted that this petitioner along with other co-accused persons named in the F.I.R., and one of the co-accused Laka Pahan has already been acquitted vide judgment dated 15.09.2018 by the Sessions Court, Khunti in Sessions Trial No.510 of 2013. He also drew attention of this Court towards the fact that one of the co-accused namely Toto Budhu Nag has already been admitted to regular bail by Coordinate Bench of this Court in B.A. No.401 of 2020 vide order dated 24.01.2020. Upon aforesaid premise, prayer for grant of bail has been made. 4. Learned A.P.P. for the State has opposed the prayer for bail on the premise that on account of absconding of this petitioner, progress of present case has been stalled for a long period of time. 5. Record transpires that there is allegation that this petitioner along with other co-accused persons committed murder of Karam Singh Munda. Annexures to present bail application show that one of the co-accused namely Laka Pahan has already been acquitted and one co-accused namely Toto Budhu Nag admitted to bail by the Coordinate Bench of this Court in B.A. No.401 of 2020. Impugned order of Sessions Court reveals that charge has already been framed against the petitioner. 6. In aforesaid facts and circumstances, this Court is inclined to grant bail to petitioner. 7. Accordingly, the petitioner, named above, is directed to be released on bail 2025:JHHC:14195 2 on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand), with two sureties of the like amount each, to the satisfaction of learned District and Additional Sessions Judge-I, Khunti in connection with Murhu P.S. Case No. 30 of 2012 corresponding to G.R. Case No.169 of 2012, S.T. Case No.316 of 2014A subject to condition that the petitioner shall appear on each and every date of hearing except medical exigency and in case of medical exigency, he shall have to produce medical prescription/paper from government hospital for seeking his personal exemption from the learned trial court and in case of non- compliance of this condition, learned trial court shall pass necessary order.
