The prayer made in the instant petition is for a direction to respondent no. 2 i.e. Court Receiver, Amrapali Home Buyer Project, Amrapali Heartbeat City, Phase-II, Sector 107, Noida, Gautam Budh Nagar, to decide the application of the petitioners dated 14.01.2025 for handing over possession of Flat No. 0-1601 Heartbeat City, Phase-II, Noida to the petitioners and not to create any third party interest over the same. 2. Concededly, respondent no. 3 was designated as construction agency in pursuance of order of Supreme Court in Writ Petition (Civil) No. 940 of 2017. 3. Counsel for the petitioners submits that respondent no. 2 was appointed as Court Receiver by the Supreme Court and is working under the supervision of the Supreme Court. 4. In such view of the matter, we are of the opinion that in case, any direction is needed, it is open to the petitioner to approach respondent no. 2 or the Court which has appointed the Receiver. 5.
