JUSTICE VINOD CHATTERJI KOUL-JUDGE ORDER 19.11.2025 Learned counsel for the respondents has filed the compliance report stating therein that in pursuance of the Judgment passed by this Court and order passed by the Hon’ble Supreme Court, the petitioner’s order of premature retirement has been recalled vide order dated 29.01.2025 and he has been allowed to draw provisional pension in terms of Article 168-D and it has been further mentioned that release of consequential benefits would depend upon the decision of criminal proceedings pending against him. It is being submitted by learned counsel for the petitioner that provisional pension to which petitioner is entitled to has not been release as per the provisions. It is being stated by learned counsel for the respondents Mr. H. Aman Ali, Dy. AG that so far as the provisional pension is concerned that would be released as per the provisions of law and in case petitioner has any grievance, he can put his grievance before the competent authority and same would be considered and decided within a period of two months. In view of the aforesaid submissions, the proceedings in this contempt are dropped and is accordingly, closed. In case, if any representation is made and disposed of by the respondents and petitioner is not satisfied, he can approach this Court a fresh.
