The present contempt application has been filed pleading willful disobedience of the order dated 13.12.2024 passed by this Court in Criminal Misc. Writ Petition No. 21198 of 2024. Through order dated 13.12.2024 this Court had stayed the proceedings registered under Sections 145/146 Cr.P.C. and had directed that the attached property shall be released in favour of the person from whom it was taken under attachment. The counsel for the applicant has not been able to show any document which indicates that possession of the property under attachment was taken from the applicants. The claim of the applicants on affidavit that the possession was taken from the applicants is not sufficient to institute proceedings under the Contempt of Courts Act, 1971. In view of the aforesaid, it is not a case to institute proceedings under the Contempt of Courts Act, 1971. The contempt application is dismissed.
