In similar facts and circumstances, a Coordinate Bench of this court at Allahabad had passed an order dated 18.07.2029 in Writ-C No. 23016 of 2019, Swati Devi v. State of U.P. & 4 others., which reads as under:-
"Heard learned counsel for the parties and perused the record. This writ petition, inter alia, has been filed for the following reliefs :-
"(i) to issue writ in the nature of mandamus directing and commanding the respondents to pay the compensation as sanctioned by District Steering Committee of U.P. Rajya Mahila Sashaktikaran Mission Jalaun, vide its recommendation dated 22nd November 2018 (Annexure no.1 to the writ petition) for an amount of rupees 3,00,000/- (Three lakh only) granted to the petitioner under the Uttar Pradesh Victim Compensation Scheme, 2014. (ii) to issue direction to respondents to pay interest w.e.f. the date of
sanction of compensation by the respondent no.5 as contained in Annexure 1 to this writ petition." The petitioner is a victim of a sexual crime. She has approached the authorities to get compensation under Rani Laxmi Bai Mahila Evam Bal Samman Kosh, 2015 which is an initiation of Women and Child Welfare Department, Government of Uttar Pradesh.
The said Kosh is governed by the Uttar Pradesh Rani Laxmi Bai Mahila Evam Bal Samman Kosh Rules,
2015. The District Committee, District Jalaun appointed under the said Rules after considering the case of the petitioner recommended victim's compensation of Rs.3,00,000/- by sanction order and recommendation of payment order dated 20.6.2019, which is annexed as Annexure No.4 to this writ petition as the case of the petitioner fulfilled the pre-requisite conditions as prescribed under the said Rules. Shri S.F.A. Naqvi, learned Senior Advocate assisted by Shri S.A. Faizan,
learned counsel for the petitioner submits that in pursuance of the abovementioned sanction and recommendation of payment order, no further action has been taken till date and no payment has been made in pursuance of the said sanction order. Learned Standing Counsel has not disputed the facts and submissions of
learned counsel for the petitioner on the basis of the record available in the writ petition. Considering the facts and circumstances of the case, this writ petition is finally disposed of with the consent of the advocate of the parties as no useful purpose will be served to keep the petition pending and call for counter affidavit. The Rani Laxmi Bai Mahila Evam Bal Samman Kosh inter alia provides to ensure monetary, medical relief, including reconstructive surgeries to women/girl child who are victims of heinous crimes, as well as educational assistance to the victims and their minor children and to provide medical and educational assistance for women/girl child who may not be directly victims of heinous crimes but require critical social and economic empowerment. There is no dispute that it is a beneficiary Scheme, therefore, any delay of disbursing the sanctioned amount to the beneficiary is against the very purpose of the said Scheme. There is no explanation for delay of about more than one month in disbursement. Therefore, we dispose of the present writ petition with the direction to the Special Secretary of Women and Children Welfare Department, Fund Management Unit, Rani Laxmi Bai Mahila Samman Kosh, Room No.413, 4th Floor, Yojna Bhawan, Sarojni Naidu Marg, Lucknow, U.P. (e-mail address - upmahilasammankosh@gmail.com) to ensure the disbursement of sanctioned amount within a period of two weeks from the date of certified copy of this order is placed before him. We have mentioned the complete address due to the reason that the petitioner has not arrayed proper Government Authorities as respondents in the writ petition. With the aforesaid directions, the petition stands disposed of."
This petition is also disposed of in the same terms as in the
judgment in the aforesaid Writ-C No. 23016 of 2019. (Syed Qamar Hasan Rizvi, J.) (Saurabh Lavania, J.)
