The applicant has approached this Court for quashing of order/notice dated 30.06.2016 issued by Sub Divisional Magistrate/Executive Magistrate, Payagpur, District Bahraich in Case No. 1, titled State Vs. Dinesh Kumar Mishra, under Section 111 of CrPC as well as challani report of Station House Officer, Police Station Visheshwarganj, District Bahraich dated 13.06.2016, under Section 110G of CrPC. Vide impugned order/notice dated 30.06.2016, under Section 111 CrPC as a preventive measure, the applicant was directed to furnish the bonds but after filing of the application, there is no progress in the case and no one has appeared on behalf of the applicant. It seems that with the lapse of time, the issue raised in the application for adjudication does not survive any more. Consequently, the application is dismissed for want of prosecution.
