Mr. Vishal Singh Mahara, Advocate, for the petitioner. Mr. Sanjay Sharma Darmora, Advocate, for the respondents. (2) Petitioner is serving as Officer in Punjab and Sindh Bank. Earlier, she was posted at Gadarpur Branch in District Udham Singh Nagar. On her request, on medical ground, she was transferred to Haldwani vide order dated 19.12.2022. Subsequently, she was re-transferred to Zonal Office, Bareilly, vide order dated 3.8.2023. Feeling aggrieved by the said transfer order, petitioner has filed this writ petition. (3) Learned Counsel for the petitioner submits that petitioner is suffering from gastrointestinal and other digestive problems and she is undergoing treatment therefor for the last more than ten years and on account of this aliment, she could not marry. He submits that petitioner’s parents are settled at Haldwani, therefore her transfer to Bareilly within less than a year of her transfer to Haldwani is unjust and illegal. (4) Per contra, learned Counsel for the bank, who is connected virtually, submits that petitioner had sought transfer to Haldwani only for a period of six months. Her request was acceded to and she was transferred from Gadarpur to Haldwani and she was thereafter transferred to Bareilly after more than eight months. He thus submits that there is no illegality or 2025:UHC:10005 infirmity in the impugned order. He further submits that pursuant to interim order passed by coordinate Bench on 10.8.2023, petitioner is continuing at Haldwani. (5) Having regard to the facts and circumstances of present case, writ petition is disposed of with liberty to the petitioner to approach the competent authority against her transfer by making a representation. If she makes representation within one week from today, decision thereupon shall be taken within three weeks thereafter. For a period of four weeks or till decision is taken, whichever is earlier, petitioner shall not be relieved from her present place of posting.
