Learned Counsel for Respondent No.3 submits that Prayer-A, which was essentially for seeking a direction to conduct a fair and impartial investigation in FIR No. 137/2017 under Sections 406/420/467/468/471/120B IPC, registered at Police Station Greater Kailash-1 into the fraud perpetrated by Respondent No. 2-5 herein regarding the development of housing project namely, Greenopolis, situated at Hayatpur and Badha, Sector 89, Gurgaon, Haryana, stands already withdrawn by the Petitioner.

The other Prayers were in regard to appointment of an independent auditor to conduct a forensic audit into Accounts of Respondent Nos. 3-5 and affairs of the Respondent Nos. 2 and 6-35 in order to trace the siphoning of funds; directing Respondent Nos. 2-35 to deposit the sum of Rs.826 Crores received from innocent Home Buyers and cheated from the Petitioner into a escrow account; and directing Respondent no. 2-35 to sell the property and assets and return the moneys cheated from petitioner and the compensation of the loss incurred towards the completion of the project.

Learned Counsel appearing for Respondent No.3 submits the Petitioner has already filed a Writ Petition for the reliefs sought in Prayers- B to D, which are civil in nature.

7. Pertinently, Charge Sheet in FIR No. 137/2017, registered at Economic Offence Wing stands already filed. Prayer A in the present Petition stands already withdrawn and Prayers B, C & D are essentially civil in nature, for which a civil Writ Petition has already been filed by the Petitioner.
