This first bail application has been moved by the applicant seeking regular bail in Case Crime/F.I.R. No.271 of 2023, under Sections 306 & 506 I.P.C., registered at Police Station Lalkuwan, District Nainital. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has no previous criminal antecedents. It is contended that the applicant has been in judicial custody since 29.06.2024. It is further submitted that there is no material to suggest that the applicant subjected the deceased to any cruelty or harassment, nor has any evidence been adduced to show that he abetted the commission of suicide. It is also pointed out that no external or internal injury suggesting physical violence has been noted in the post-mortem report. Learned counsel submits that the applicant has two minor children and an aged mother who are dependent upon him, and that he is the sole breadwinner of the family. 4. Per contra, learned State Counsel has opposed the bail application and submitted that the nature of accusation is grave, as the case pertains to the 2025:UHC:10024 alleged abetment of suicide of the applicant’s wife. It is argued that the subsequent conduct of the applicant and the surrounding circumstances prima facie indicate his involvement in the offence under Section 306 I.P.C. Hence, no indulgence should be granted at this stage. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Govind Singh Mehta be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
