Neutral Citation No. - 2025:AHC-LKO:34681-DB Court No. - 2 Case :- WRIT - C No. - 5738 of 2025 Petitioner :- Amar Nath Respondent :- State Of U.P. Thru. Secy. Revenue Deptt. Lko. And 6 Others Counsel for Petitioner :- Umesh Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Praveen Kumar Giri,J.
1. Heard.
2. The petitioner seeks a writ of mandamus commanding the official respondents not to stop construction by the petitioner over land bearing Gata No.1271. There is a suit pending, which has been filed by opposite party Nos.6 and 7 against the petitioner in respect of this very land. However, there is no temporary injunction in their favour. The allegation is that the police authorities are interfering in the construction.
3. Without in any manner expressing any opinion on the issues involved in the suit and without interfering with the private dispute between the private parties as far as the police is concerned, the same should not come into the picture unless and until there is an apprehension of breach of peace, apprehension of commission of any crime, a law and order problem, any order of the court to be complied or any other valid ground in law for their interference, which would obviously be for maintenance of law and order, prevention of crime or investigation etc and not otherwise.
4. Accordingly, the writ petition is disposed of. (Praveen Kumar Giri, J.) (Rajan Roy, J.)
