Civil Writ Petition No.6881/2021, which came to be dismissed for non-prosecution vide order dated 21.09.2023. 2. Counsel for the petitioner submits that on account of his bona fide mistake and due to removal of tooth of petitioner's Advocate no one could not appear on 21.09.2023, when the petition was called on board. 3. Considering the reasons assigned in the application and the fact that the restoration application has been filed soon after having knowledge of rejection of petition as also considering the issue involved in the writ petition, this Court deems it just and proper to allow the instant restoration application.
