Let the petitioner initiate the proceedings under Section 24 of the U.P. Revenue Code, 2006 read with the corresponding rules, and, as soon as the proceedings are initiated, it shall be considered and disposed of at the earliest in accordance with law. Based on the result of the said exercise, if it is found that the petitioner has not encroached upon any land which is recorded as 'Raasta' or for any other public purpose, then the revenue authorities specially the Lekhpal shall not unnecessarily interfere with the holding of the petitioner. However, if it is found that the petitioner has encroached upon the said land, then remedial measures can be taken subject to right of further challenge to the petitioner. The writ petition is disposed of in the aforesaid terms.
