1. Heard Mr. A.M.S. Mazumdar, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State.
2. This is an application under Section 482 of the BNSS, 2023,
Page No.# 2/3 seeking pre-arrest bail to the accused/petitioner, namely, 1. Pranita Chakraborty, in connection with Jalukbari P.S. Case No. 186/2025, under Sections 108 of the BNS, 2023(corresponding to GR Case No.2190/2025).
3. The gist of the allegation and the FIR dated 24.04.2025 is that the deceased was the owner of one cloth shop in Guwahati in which the accused petitioner herein was an employee who had some relationship issue with the victim, pursuant to which she started pressurizing/blackmailing him, eventually resulting in suicide of the victim by jumping into river.
4. The petitioner was granted interim bail on 14.08.2025, whereupon she is stated to have appeared before I.O and recorded her statement – which is confirmed by the learned Additional Public Prosecutor for the State.
5. It is submitted by the prosecution that from a statement, it appears that the deceased was concerned about the societal acceptance of their relationship due to a difference in religion.
6. The learned Additional Public Prosecutor for the State submits that upon perusing the case diary, he did not notice materials indicating blackmailing by the petitioner.
7. In the circumstances and also especially as she has rendered her cooperation to the investigation, the interim bail granted on 14.08.2025 is hereby made absolute subject to the conditions : i) That the petitioner shall co-operate with the
Page No.# 3/3 remaining investigation ; ii) That the petitioner shall not hamper or tamper with evidence.
8. Return back the case diary.
9. Accordingly, the anticipatory bail petition stands disposed of.
