CMP(M) No. 2411 of 2025 The present application has been filed for condonation of delay in filing the present appeal. It is averred that the impugned judgment and decree were passed by the First Appellate Court on 26.06.2025. Although the certified copy of the impugned judgment and decree was applied for and obtained on 04.07.2025, but applicant, being a senior citizen, was suffering from age-related ailments and on account of his medical condition, he was advised by a local doctor to avoid immediate travel. It was only in November 2025 that the applicant discussed the matter with a relative and then he was informed that the limitation period for filing the Regular Second Appeal had expired. Immediately thereafter, the applicant took the necessary steps to file the present appeal. The applicant has further submitted that the delay in filing the present appeal is neither intentional nor deliberate, but has occurred on account of bona fide reasons, as stated in the application. In view of the averments as made in the application which is duly supported by an affidavit and in view of the submissions made by learned counsel for the parties, the present application is allowed and the delay of 66 days in filing the appeal is condoned.
