Learned counsel for the petitioner submits that Miscellaneous Case No. 290 of 2013 has been filed only to delay the proceeding and to frustrate the decree order dated 9th of September, 2008. Learned counsel for the opposite parties has accepted notice. Learned counsel for the opposite parties has very fairly submitted that he has no objection if the directions to be issued to the learned Trial Court for expeditious disposal of Miscellaneous 2 Case No. 290 of 2013 arising out of Title Suit No. 27 of 2002. In view of the submissions made by the learned 1st Civil Judge (Senior Division) at Barasat, North 24 Parganas is directed to dispose of Miscellaneous Case No. 290 of 2013 arising out of Title Suit No. 27 of 2002 expeditiously in accordance with law on or before 31st December, 2025. The petition and all pending applications, if any, shall stand disposed of.
