Mr. Kailash Chandra Tiwari and Mr. Vibhor Tiwari, learned counsel for the applicants. 2. Mr. Sandeep Sharma, learned Deputy Advocate General with Ms. Meenakshi Sharma, learned Brief Holder for the State. 3. Present applicants “Tara Devi, wife of Kamal Swaroop and Kamal Swaroop, son of late Gangaram,” are seeking regular bail in relation to FIR dated 23.08.2025 bearing FIR No. 0068 of 2025, Police Station – Rani Pokhari, District – Dehradun wherein present applicants and other family members have been implicated for the offences punishable under Section 111 (2) (B), 191 (2), 329 (3), 351 (2) BNS, 2023. 4. Learned counsel for the applicants submits that applicants are innocent and have been falsely implicated, which is evident from the fact that not only the applicants the entire family members have been implicated. 5. He further submits that as per the contents of the FIR, the allegation appears to be civil in nature and the present applicants are languishing in jail since 24.08.2025. He further submits that applicants’ son has already been enlarged on bail and their daughter-in-law has been given anticipatory bail. 6. On the previous date, State Counsel was directed to get instructions in the matter. 7. Mr. Sandeep Sharma, learned Deputy Advocate General on instructions apprised to this Court that as many as ten FIRs have been lodged against the present applicants with the same nature of allegations. 2025:UHC:10406 8. Be that as it may, prima facie, from the contents of the FIR, allegation appears to be civil in nature. 9. After hearing the arguments of learned counsel for the parties and further taking into consideration that entire family have been implicated and applicant Kamal Swaroop is aged about 73 years of age and applicant Tara Devi being a lady, has right of privilege to be released on bail and co-accused has already been enlarged on bail and anticipatory bail has already been granted to the daughter-in-law of the applicants, this Court is of the view that the applicants deserve for bail. 10. Accordingly, without expressing any opinion on the merit of the case both the bail applications are allowed. 11. Let the applicant “Tara Devi, wife of Kamal Swaroop and Kamal Swaroop, son of late Gangaram,” be released on bail on furnishing their personal bond and two sureties, by each of them, each of the like amount to the satisfaction of the court concerned.
