Harbola, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. with Mrs. Meenakshi Sharma, learned Brief Holder for the State. 3. The present applicant ‘Vipin Chamoli’ S/o Dinesh Chamoli is praying for bail in reference to First Information Report dated 0042 of 2024 P.S. Bhatrojkhan District Almora, wherein, the present applicant and his father Dinesh Prasad Chamoli have been implicated for the offence punishable under Sections 420, 406, 504 and 506 of IPC. 4. It is contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and the FIR has been lodged by close relative implicating his father also. 5. Apart from this, he submits that the huge amount was also returned back to the complainant and for remaining amount a cheque was given, which was dishonoured. Apart from this, he submits that the allegations prima-facie appears to be civil in nature and furthermore the charge- sheet has already been filed and as such there is no need of the custodial interrogation and the present applicant is languishing in jail since 06.07.2025. Apart from this, learned counsel for the applicant also submits that all the offences are triable by Magistrate. 6. On the other side, learned State counsel have not disputed that the charge-sheet has already been filed and as such there is no need of the custodial interrogation of the present applicant. 7. After hearing the arguments of learned counsel for the parties and further taking into consideration that the charge-sheet has already been filed and there is no need of the custodial interrogation, this court is of the view that the applicant deserves for bail. 2025:UHC:10413 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Vipin Chamoli’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
