ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“.... to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not sanctioning the permission for the petitioner’s application dated 22.06.2015, for construction and development of the property, by showing the petitioner’s land as a open space, is illegal, arbitrary and violation of principles of natural justice and consequently direct the respondents to sanction the permission to the petitioner in respect of the land in an extent of Ac.0-47 cents, situated at Madhurawada, Visakhapatnam...”
2. Today, when the matter came up for hearing, learned Standing Counsel representing the 2nd respondent stated that the petitioner had submitted an application to the 2nd respondent instead of submitting the same to the 5th respondent, seeking building permission. The learned Standing Counsel further stated that, despite their best efforts, they could not trace out the application submitted by the petitioner on 22.06.2015.
3. In view of the same, instead of keeping the writ petition pending, the writ petition is disposed of with a liberty to the petitioner to submit a fresh application to the 5th respondent seeking building permission. Upon receiving such application, the 5th respondent shall consider the same in accordance with law. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
