The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Sessions Trial No. 41 of 2023, “State vs. Prakash Singh”, pending before the court of Additional Sessions Judge, Pithoragarh under Sections 307, 452 and Section 504 of the Indian Penal Code, 1860. 2. According to the First Information Report dated 08.08.2023, the applicant entered the informant’s room on 08.08.2023 and beat him, due to which he (informant) got injured. 1 2025:UHC:9620 3. Mr. M.S. Dhapola, learned counsel for the applicant-accused. 4. Mrs. Sweta Badola Dobhal, learned Brief Holder for the respondent no. 1. 5. Mr. Devendra Singh, learned counsel for the respondent no.2/informant-injured. 6. According to the parties, the applicant is the real nephew of the informant. The applicant and respondent no.2 are present in person. Applicant is identified by Mr. M.S. Dhapola, Advocate and respondent no.2 has been identified by Mr. Devendra Singh, Advocate. 7. Both, the applicant and the respondent no.2 submitted that now, they are living happily and in harmony. They have filed a Compounding Application (IA No.01 of 2025) and affidavits with their free will and without any pressure. 8. The respondent no.2 has requested to quash the entire proceedings of the said Sessions Trial No. 41 of 2023. 9. The said request has been opposed by the respondent no.1 on the ground that Section 307 of the of the Indian Penal Code, 1860 is non-compoundable. 10. Considering the totality of the matter, this 2 2025:UHC:9620 Court is of the view that ends of justice would be met if the entire proceedings of Sessions Trial No. 41 of 2023, “State vs. Prakash Singh”, pending before the court of Additional Sessions Judge, Pithoragarh, are quashed. 11. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Sessions Trial No. 41 of 2023, “State vs. Prakash Singh”, pending before the court of Additional Sessions Judge, Pithoragarh, are hereby quashed. ___________________ ALOK KUMAR VERMA, J.
