PUBLIC PROSECUTOR The Court made the following: ORDER: The Sub Inspector of Police, Narpala Police Station, Ananthapur District, submitted report stating that the petitioner No.1 Pittu Govardhan Reddy died on 31.03.2015. To that effect, photo copy of the death certificate is filed. The revision against the petitioner No.1 is abated. 2. Bailable Warrant issued against the petitioner No.2 is executed. The petitioner No.2 Pittu Palakshi Reddy is present. Erroneously, the petitioner No.2 was arrayed in the revision case inasmuch as the learned I Additional Sessions Judge, Ananthapur in his judgment in Criminal Appeal No.13 of 2008 at para No.35 in page No.17, confirmed the conviction of the petitioner No.2 for the offence under Section 324 of I.P.C., but modified the sentence from one year Rigorous Imprisonment to the sentence which the petitioner No.2 had already undergone. Therefore, the Revision Case is liable to be dismissed as abated in view of the fact that the petitioner No.1 died on 31.03.2015 and revision against petitioner No.2 is not at all maintainable. 3. In the result, the Criminal Revision Case is dismissed as abated. No order as to costs. As a sequel, interlocutory applications, if any pending, shall stand closed. _________________________ DR. Y.
