Heard Shri Gautam Bhagel, learned counsel for petitioner and Shri Siddharth Singhal, learned counsel appearing for respondent Corporation. 2. Petitioner who has been applicant for the post of Auxiliary Nurse Midwife pursuant to the advertisement issued on 04.12.2024 by the Commission is aggrieved for non-consideration of her candidature despite the fact that she has successfully filled up the online application form and had took out the print out as per clause 2.7 and had also submitted the requisite fee to participate in the selection process. He has brought to the notice of the Court the print out application form taken by petitioner as annexure No. 6 to this petition also the print out of fee deposit made. It is submitted that fee was deposited well within time. 3. Shri Siddharth Singhal has obtained instructions in the matter and submits that even though petitioner had successfully filled up the application for and also deposited the examination fee as required under the advertisement to be paid but failed to click the final button of submission of the entire application form along with fee and to get a print out of the same so that the process of filling up of form of the application along with requisite fee stood concluded and the petitioner having failed to do so, her application could not be registered by the Commission as the last date had also crossed. 4. Considering the special facts and circumstances of the case, where the online application form was filled up successfully and uploaded online within the time as prescribed for and also requisite fee was deducted from the account of the petitioner within the time prescribed by the Commission under the advertisement, I consider it to be a very hard case in the event petitioner's candidature is declined only on the ground that she could not press the final button for online submission of the complete form. It is not a case where any correction was required to be done, nor is it a case where any anomaly has been detected by the Commission. 5. In the given facts and circumstances, therefore, I consider it to be an exceptional circumstance where the petitioner should be given an opportunity to participate in the selection process. Hence, I dispose of this petition with a direction to the respondent Commission to consider the candidature of the petitioner for the post of Auxiliary Nurse Midwife if otherwise there is no deficiency found in the details filled up by the petitioner and no deficiency is found in the fee deposited by the petitioner. 6. It is however, made clear that this order has been passed in exceptional circumstances of this case and shall be not a binding precedent.
