Counsel for the petitioner states that after the passing of the judgment and decree dated 02.04.2022 (Annexure P-1), the respondent filed an appeal which was rejected by the learned District Judge, Gurugram vide order dated 08.02.2023 (Annexure P-2). He submits that respondent has filed a second appeal before this Court which is pending. In the meanwhile, petitioner has filed an application (Annexure P-3) for passing of the final decree of partition which is being adjourned on the request of the respondent. 2. Counsel submits that a direction be issued to the Court to decide the application (Annexure P-3) in a time bound manner. 3. After hearing counsel for the petitioner, present petition is disposed off with the direction that the Trial Court shall make an endeavor and decide the application as expeditiously as possible.
