Thru. Secy. Deptt. Of Home Lko. And Others Counsel for Petitioner :- Rakesh Kumar Nayak,Anand Dubey Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Om Prakash Shukla,J.
1. We have heard learned counsel for the petitioner, who says that he has been served a copy of the short counter affidavit supposed to be filed by the State and he wishes to file rejoinder affidavit to the same.
2. Learned A.G.A. for State-respondents, however, has argued that the matter has become infructuous, as the petitioners have challenged the notice under Section 3(1) of the Uttar Pradesh Control of Goondas Act, 1970 registered at Police Station Akhand Nagar, District Sultanpur.
3. This Court by its order dated 25.11.2024 only stayed the arrest of the petitioners on the basis of impugned notice and that too till such time that sufficient and credible evidence is available against them. Now a final order has been passed by the competent authority.
4. The writ petition indeed become infructuous. It is dismissed as such.
5. However, leaving it open for the petitioners to challenge the final order, if they so advised, before the appropriate Forum. Order Date :- 23.1.2025 Shubhankar Digitally signed by :- SHUBHANKAR THAKUR High Court of Judicature at Allahabad, Lucknow Bench
