This writ petition has been filed for grant of 1 Whether reporters of Local Papers may be allowed to see the judgment? yes - 2 - following reliefs:- “(A) That the respondents may kindly be directed to grant benefit of 2 years of regular service against 10 years of daily wage service rendered by the petitioner for the purpose of pension in the light of the judgment rendered by this Hon'ble Supreme Court in the Civil Appeal No. 6309 of 2017 and by this Hon'ble Court in Roop Lal's case (LPA No. 196/2022, decided on 11.10.2023). (B) That after allowing the prayer as per Clause (A) supra the respondents may kindly be directed to process the case of the petitioner for sanction of pension and other retiral benefits in a time bound manner. C) That the respondents may kindly be directed to sanction pension and other retiral benefits to the petitioner in a time bound manner and pay the same along with interest @9% from due date till its actual payment.” 3. Petitioner seeks applicability of decision rendered in Roop Lal Versus State of H.P. & Others2 as also the decision rendered in Sunder Singh Versus The State of Himachal Pradesh & Ors.3 and Balo Devi & others Versus State of Himachal Pradesh and others4 in order to make himself eligible for grant of pension and pensionary benefits. 2 LPA No.196 of 2022, decided on 11.10.2023 3 Civil Appeal No.6309 of 2017, decided on 08.03.2018 4 Civil Appeal No.4792 of 2022, decided on 18.07.2022 - 3 - 4. It appears that petitioner has not preferred any representation to the respondents for grant of aforesaid reliefs. This writ petition is, therefore, disposed of by permitting the petitioner to prefer representation for redressal of his grievances to the Competent Authority within two weeks from today, thereafter, the same shall be considered and decided by the Competent Authority within six weeks in accordance with law keeping in view the aforesaid judgments. The decision so arrived at, shall be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
