By means of this present C582 application, the applicant has challenged the charge-sheet No.01 of 2024 dated 01.09.2024 filed pursuant to the FIR No.0278 of 2023, summoning order dated 21.01.2025 passed by learned Additional Chief Judicial Magistrate, Haldwani, District Nainital, in Criminal Case No.213 of 2025 State Vs. Sarswati Bisht, under Sections 279 and 338 of IPC as well as the entire proceedings of aforesaid Criminal Case. 4. After arguing for considerable length on the merits of the case, learned counsel for the applicant placed reliance upon the authority of Apex Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation and Another, reported in (2021) 10 SCC 773. For the sake of convenience, relevant portion thereof is quoted herein below:- 3.Category A(e) Bail applications of such accused on appearance may be decided without the accused being taken in physical custody or by granting interim bail till the bail application is decided. 2025:UHC:10519 5. In such view of the matter, present C528 application is disposed of permitting the applicant to surrender before the concerned court on or before 04.12.2025; and she shall be dealt with in view of dictum of the Apex Court in the case of Satender Kumar Antil (Supra). 6.
