Let the petitioner implead Principal Secretary, M.S.M.E. and Export Promotion U.P. during the course of the day. 3. The grievance of the petitioner is that M.S.M.Es are entitled to certain exemptions so far as work experience and/or turn over conditions prescribed in tenders is concerned. He says that in some of the districts the exemptions are being given such as in District-Balrampur but in other districts such as District- Gonda, Barbanki, Bahraich and Lakhimpur etc., where tender notices have been issued which are impugned herein, the said exemptions are not being given. This disparate treatment without any justification is against the spirit of the Constitution of India. Let the newly impleaded party and the opposite party No.1 consider the grievance of the petitioner in this regard jointly as the tender is for supply of material for effective flood relief and as to whether the tender conditions are in accordance with law or not and take a decision in this regard at the earliest say within 15 days' from the date a certified copy of this order is produced before them. Shri Rajesh Tiwari, learned Additional Chief Standing Counsel for the State shall communicate our order to both the said officers for compliance. 4.
