Sri Manish Johari, learned counsel for electricity corporation says that the letter impugned is merely a communication by the Executive Engineer to the Additional Sessions Judge/ Electricity Act, Ambedkar Nagar about theft having been detected on 06.07.2014 at the premises in question and electricity dues of Rs.1695060.00 as also the compounding fee of Rs.7,20000.00 which has not been deposited by the petitioner, however, till date, no recovery certificate has been issued by the electricity department nor any citation of recovery has been issued. In fact, after issuance of provisional assessment, no final assessment has been made as yet. He says that so far as the proceedings before the court are concerned, they were for the purposes of bail on account of an F.I.R. having been lodged against the petitioner for the theft aforesaid but so far as recovery is concerned, as of now, there is no such order nor any proceeding. 3. In view of the above, we see no reason to entertain this petition against the impugned letter. The petitioner may respond to the provisional assessment within the next two weeks whereupon representation/ objection would be considered and final assessment would be made as per law unless there is any legal impediment.
