State Public Distribution System (Control) Order, 2008 and its Guidelines issued in G.O.Ms.No. 4 (Consumer Affairs, Food and Civil Supplies (CS-1) Department Dt 19.2.2011 and violation of Articles 14,16 and 21 of the Constitution of India and consequently direct the 4th respondent issue fresh Notification in accordance with CCS Ref.No.N4/4361/2011, dated 28.09.2011 issued by the Commissioner of Civil Supplies, and pass IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to stay of all further proceedings vide D.Dis.1190/CS/2017-1, dated 29.11.2017 issued by the 4th respondent, in respect of the FP. GP FOR CIVIL SUPPLIES (AP) The Court made the following: 3 VS,J W.P.No.7779 of 2018 ORDER The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 4th respondent in issuing proceedings vide D.Dis.No.1190/CS/2017-1, dated 29.11.2017 in appointing the 6th respondent as Fair Price Shop Dealer of Shop No 41 of Sirivella Village and Mandal, Kurnool District under Open Category (Women) as illegal, arbitrary, contrary to the procedure contemplated under A.P. The Writ Petition was filed in the year 2018 and no interim order has been passed by this Court in this writ petition. 3. The learned Assistant Government Pleader for Civil Supplies, on oral instructions, has stated that as of now, the 6th respondent has been running the said Fair Price Shop since the date of her appointment. As such, stated that no further cause survives in the present writ petition. 4. In view of the fact that the writ petition is pertaining to the year 2018 challenging the appointment of the 6th respondent, and the petitioner could not secure any interim order, and also considering the 4 VS,J W.P.No.7779 of 2018 fact that the 6th respondent is running the said Fair Price Shop since the date of her appointment till date, this Court is of the opinion that no interference therewith is warranted at this stage. 5. Accordingly, the Writ Petition closed. It is needless to state that the petitioner is at liberty. There shall be no order as to costs.
