SREENIVASA REDDY Criminal Petition No.4199 of 2025 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioner/A7 to grant anticipatory bail in connection with Crime No.412 of 2023 of Ongole I Town Police Station, Prakasam District. A case has been registered against the petitioner herein 2. and others for the offences punishable under Sections 420, 467, 468, 471 read with 34 of I PC. Case of the prosecution, in brief, is as follows. 3. The informant Sri V. Rama Krishna, Joint Sub Registrar lodged report to Police alleging that the Petitioner herein and others created forged documents and submitted in the Office of Registrar, for registration, as genuine documents and also they forged the signatures of both Revenue Officials and Health Officer for creating documents and also created fake Family Member Certificate and Death Certificates. Basing on the said report, the case has been registered against the petitioner herein and others. 2 Learned counsel appearing on behalf of the petitioner submits that the petitioner has been implicated basing on the confessional statement of co-accused. Except, the confessional statement, there is no other incriminating material against him. Apart from that, the petitioner has been shown as Accused-7 for the reason that he stood as witness in the document. Therefore, 4. he requested to allow the application. Learned Assistant Public Prosecutor for the Respondent/ 5. State submits that in the confessional statement of the purchasers, it is alleged that the petitioner herein is the person, who created the documents, after knowing that the owners of the lands and their legal heirs were not traceable. Prima facie, the fabricated documents stand in the name of Accused Nos.2 and 3. Accused No.1 was the person, who alienated the properties to the purchasers. Basing on the confessional statements made by the purchasers, the petitioner and others were shown as Accused and as many as 110 cases are registered against the petitioner herein. 6. Heard. Perused the record. The prosecution case is that the petitioner along with other accused is alleged to have involved in creating Sale Deeds and 7. \ 3 fabricated Title Deeds of the owners of the lands, who are not traceable. The said Crimes were registered in the year 2023. In the month of January-2025, Police recorded the statements of respective purchasers of the land from Accused-1, wherein the petitioner is said to have been a witness in the sale deed. There is absolutely no explanation for the delay so caused. Apart from the same, basing on the confessional statement of the co-accused, the name of the petitioner was shown as Accused No.7 at belated stage i.e after lapse of two years. 8. It is pertinent to mention here that in respect of Accused No.6 in Crime No.774 of 2023, this Court granted anticipatory Bail in Crl.P.No.9748 of 2023, dated 09.01.2025. Therefore, it can be safely inferred that the petitioner stand on the same footing as that of Accused No.6. The petitioner has fixed abode and the question of he absconding does not arise. In view of the said reason, this Court is inclined to grant anticipatory bail, however, on certain conditions. 9. Accordingly, in the event of the arrest of petitioner/A7 in the aforesaid crime, he shall be released on bail on his executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of B the arresting police petitioner shall w/hen required or promise to the before the Station 10.00 officials make himself end that he shall and also on condition that the investigation available for i as and any threat, inducement Petitioner shall not cause prosecution witnesses.
