In the proceedings under section 122-B of the U.P. Z.A. & L.R. Act, 1950, an order was passed on 03.11.2017, albeit an ex- parte order, for removal of encroachment of Gram Sabha land. The revision was filed by the petitioner which has been dismissed on 15.09.2022, but the petitioner claims pendency of an application for recall of the said order. The learned counsel for the opposite party no. 2 says that no such application is pending. Considering the facts of this case, especially the disputed questions of fact, the petitioner will have to avail other remedies as permissible in law. Accordingly, the writ petition is disposed of.
