In both the applications preferred under Section 528 of BNSS, 2023 the applicants are same challenging the proceeding initiated for the offence punishable under Section 135 of the Electricity Act. 5. Mr. Dharmendra Barthwal, learned counsel for the complainant, submits that the offence punishable under section 135 of Electricity Act is compoundable in terms of Section 152 of the Electricity Act and apprise to this court that the applicant is not appearing before the Trial Court due to which Trial Court issue Non- Bailable Warrant against the applicant. 6. Since the offence as alleged are compoundable the applicant can approach to the Trial Court for compounding. 7. In such view of the matter, both the applications are disposed of finally with the direction to the applicant to appear before the Trial Court on 05.01.2026. 8. Till 05.01.2026 the NBW issued against the applicant shall remain in abeyance. 9. It is made clear that if the applicant failed to appear before the Trial Court on 05.01.2026 the NBW issued against the applicant shall revive. 10. No order as to costs.
