IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR
WP(C) 418/2025 CM(976/2025) Muneer Akhter and Anr …Appellant/Petitioner(s) Through: None. Vs. Union Territory of J and K and Ors. …Respondent (s) Through: Mr. Faheem Nisar Shah, GA
CORAM:
HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE
ORDER 26.12.2025
1. Petitioners aged 23 years and 25 years respectively claim to have contracted marriage out of their own free will and volition.
2. The instant petitioner has been filed on the apprehension that the respondents 5 and 6, who are opposed to their marriage, are threatening to harm the life and liberty of the petitioners.
3. This petition came up for consideration on 1st March, 2025, when this Court while issuing notice to the respondents also directed the respondents 1 to 4 to provide protection to the petitioners as and when they approach them with their grievance in this regard. The aforesaid order which was passed on 1st March, 2025 is still in operation. It seems that the petitioners have reaped the benefit of the said order and are staying together peacefully without any interference from the respondents. It is because of this reasons perhaps that they have taken no steps for service of respondents 5 and 6. They have chosen also not to appear in the matter.
4. Be that as it may, having regard to the nature of the controversy involved, this petition is disposed of by directing that in case the petitioners still apprehend any threat to their life and liberty, they shall be free to approach the concerned police station for seeking protection. Needless to say that the police authorities, if approached by the petitioners in this regard, shall take remedial measures as are permissible in law so as to ensure the protection of their life and liberty.
5. Disposed of.
